A quotation does not constitute a binding agreement until payment has been received or a written agreement has been accepted.


4. Payment

Full or partial payment may be required before work commences.

Projects will not begin until payment has cleared.

Failure to pay any outstanding balance may result in suspension or termination of services.


5. Client Responsibilities

The client agrees to:

  • Provide accurate information.

  • Supply all required materials promptly.

  • Respond to requests within a reasonable time.

  • Ensure they own or have permission to use all content supplied.

Delays caused by the client may extend project timelines.


6. Project Delivery

Estimated completion dates are provided for guidance only.

We shall not be liable for delays caused by:

  • Third-party providers

  • Hosting companies

  • Domain registrars

  • Software failures

  • Events beyond our reasonable control


7. Revisions

Unless otherwise stated in writing, each project includes the number of revisions specified in the purchased package.

Additional revisions or changes outside the agreed scope may incur additional charges.


8. Scope Changes

Any request that falls outside the agreed scope of work shall be treated as a new service and may require additional fees and revised delivery times.


9. Intellectual Property

Ownership of completed work transfers to the client only after all outstanding invoices have been paid in full.

Until payment has been received, all designs, source files, concepts, and deliverables remain the property of Elevate Identity Ltd.

We reserve the right to showcase completed work in our portfolio unless the client requests confidentiality in writing before work begins.


10. Third-Party Services

Our services may involve third-party software, hosting providers, payment processors, plugins, APIs, or platforms.

We are not responsible for:

  • Third-party outages

  • Security incidents affecting third parties

  • Changes to third-party pricing

  • Platform policy changes

  • Account suspensions imposed by third parties


11. Website Maintenance

Unless a maintenance agreement has been purchased, ongoing updates, backups, security monitoring, plugin updates, bug fixes, and technical support are not included after project completion.


12. Client Content

The client warrants that all materials provided do not infringe the intellectual property rights or other legal rights of any third party.

The client agrees to indemnify Elevate Identity Ltd against claims arising from content supplied by the client.


13. Limitation of Liability

To the maximum extent permitted by applicable law, Elevate Identity Ltd shall not be liable for any indirect, incidental, special, consequential, or economic losses, including but not limited to loss of profits, loss of business, loss of goodwill, loss of revenue, loss of data, or interruption of business.

Our total aggregate liability arising from any claim relating to our services shall not exceed the amount actually paid by the client for the specific service giving rise to the claim.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.


14. No Guarantee

While we aim to deliver high-quality services, we do not guarantee:

  • Search engine rankings

  • Sales increases

  • Business growth

  • Website traffic

  • Customer enquiries

  • Marketing performance

  • Approval by third-party organisations

  • Acceptance of branding by target audiences

Results depend on numerous factors beyond our control.


15. Refund Policy

Payments for digital services are generally non-refundable once work has commenced.

If work has not yet started, refunds may be considered at our sole discretion, less any administrative or payment processing costs.

Completed work, partially completed work, consultations, custom designs, and digital deliverables are non-refundable except where required by applicable law.


16. Cancellation

We reserve the right to cancel or refuse any project if:

  • abusive or threatening behaviour occurs;

  • fraudulent activity is suspected;

  • information provided is false or misleading;

  • payment is reversed or disputed improperly; or

  • the requested work is unlawful or unethical.

Where appropriate, payment may be refunded after deducting work already completed and reasonable administrative costs.


17. Chargebacks

By purchasing from us, Customers agree to contact us and provide a reasonable opportunity to resolve any dispute before initiating a chargeback.

*Fraudulent or unjustified chargebacks may be defended using project records, communications, invoices, and delivery evidence and some instances might not be accepted.

19. Force Majeure
